What you need to Know:
There are typically 3 types of service in an Eviction:
Personal, Substituted Residential, and Posted Service.
What's the Difference?
Personal Service-- means that you got service on a the named defendant in the case.
Residential Service-- means that you got Service on a resident, Occupant or delegate of the defendant of the property that is able to accept.
Posted Service-- means that No one was available, or the server didn't receive an answer upon attempt and had to post the paperwork on the door. In this Case, the Documents Must be Mailed via Certified mail as Well
*These 3 services affect the type of Judgement you will be granted. If you Get personal or residential service, you will be entitled to any monies owed as well as possession of the property back. If the service is Posted service, then you are entitled to Possession of the property ONLY.

How The Process Should Go
Courtroom Procedure

The Docket
The Docket will be called at the time and date specified on your paperwork. The Calling of the Docket is a legal way of saying ‘Taking Attendance’. When your name, or case is called, inform the Judge that you are here and whether you are the Plaintiff or the Defendant.
A. If the Plaintiff is present and there is Good Service, but the Defendant does not appear, the Judge will decide the case. You will typically get a Default Judgement against the Defendant Based on your Service
B. If the Plaintiff is present and there is NOT Good Service, the Judge will Authorize what is known as an “Alias”. The Plaintiff must go to the Court Clerk's office to file an Alias. The court room clerk will give you a form with the Judge’s Signature Authorizing an issuance of the Alias. If the Plaintiff wishes to continue with the lawsuit, Plaintiff must go to the Court Clerk's office to file the Alias Paperwork. The Plaintiff Will Receive a New Court Date and then Attempt to get the Party Served again.
C. If the Plaintiff is Not present, but the Defendant is present, the case may be Dismissed/Stricken.
D. If neither the Plaintiff nor the Defendant appears, the case could be stricken or dismissed, depending on service.
What is Good Service?
Good Service means that the affidavit or summons has been delivered to the Defendant or Intended party according to the requirements of the law. Unless these requirements are met, the law does not permit the Judge to give the Plaintiff judgment. This is true EVEN IF the Plaintiff can prove that the Defendant knows the date and time of the hearing.
After the Docket has been called, there will be a recess for the Judge to sign the Journal Entries (Judgments) for those who have received judgment as well as take care of other administrative matters
A. Journal Entries must be checked by the Bailiff or Clerk before presentation to the Judge for signature.
B. When the Journal Entry is presented to the Judge, he/she will determine the right to recover. Please have ready any Notices, Promissory Notes, Repair Estimates or other documents for the Judge to inspect.
C. After the Judge has signed the Journal Entry, take it to the Court Clerk's office to file in
Agreed Journal Entry and Agreements
A. During the recess, the Plaintiff and Defendant are encouraged to go out and Speak about Resolutions. Parties are required to show each other documents, photos, evidence, etc. that they intend to show the Judge. The Parties May also reach an agreement.
B. If the parties reach an agreement, then the defendant and plaintiff both sign the Journal Entry. The Journal Entry must show the amount owed.
C. The Defendants are usually able to leave after signing the Journal Entry and the Plaintiff may present it to the Court for signature. The Plaintiff will then file Journal Entry.
D. If the Parties want to simply Agree to other terms, then this is also allowed. Parties are able to agree to terms that the Judge can't Obligate the parties to Agree to, but the Judge is able to Enforce Most Agreements that are Proposed to him/her.
Examples: Parties Agree to pay next week, Plaintiff agrees to accept partial payment on a specified day and remaining payment on an another agreed Specified day, Allow the Defendant to Move out/Break the Lease as long as the Keys are turned in and property is clean, Continue the Case to a Specified date to ensure that certain requirements are met, etc.
All Journal Entries must be signed on the day they are heard in court unless specific permission is obtained from the Judge. Along with the Journal Entry are other forms typically needing to be presented Along with The Journal Entry to Ensure that that the Journal Entry can Be Signed. These Forms Typically Include:
1. A Copy of your 5 Day Notice or Other Notice Pursuit to the Lawsuit (If Eviction). Not Just the Notice Itself but how it was served
2. A Copy of the Lease and/or Ledger (F.E.D/ Eviction.) if Applicable or A Contract, Invoice, or Agreement if Applicable (Small claims)
3. Military Affidavit- This Document is to Verify that the Tenant/ Defendant is Not in the Military and if so, Not currently Deployed Fighting for our Country.
4. A Dept of Defense Printout. If the Defendant’s/Tenant’s Name and Birthdate is Know then you can go to the Dept of Defense Website and Search the Defendant. You Will be able to Print out what’s known as the D.O.D. Printout to Accompany your Military Affidavit.
5. Entry of Appearance. This form is needed if you are there in place of a business. If you are the named Plaintiff then this form won’t be needed. However, if you work for the named plaintiff, or a delegate for the company named then you will need this form
After the recess to sign Journal Entries, the contested cases will be heard. Both parties to the lawsuit are expected to present all witnesses and evidence at that time
When the Judge rules on the Case, the court will award court costs and attorney fees, if applicable. The Judge cannot help collect on the judgment. For advice on how to collect the judgment, consult an attorney

Q. How Much Will my Eviction Cost?

Q. What if I Already have my Documents Prepared and Simply need Service?
A. If you already have your documents Prepared and only need service, then Simply checkout with the Service only Added to your cart. After Checkout, you can Email the documents to us.
Q. I Have Already Served the 5-Day notice, Do I Need to Have you serve it again
A. No. If you have already served the 5-Day Notice then you Do Not have to have us serve it. However, You can have us serve an extra 5 day notice as precaution if you'd like.
Q. I have Already Filed the Court Papers and Forgot to Serve the 5 Day notice, What can I Do?
A. If you have not yet served the Court Documents, then you can add the 5-Day Notice to be Served and still be ok.
Q. What's the Importance of a 5-Day Notice?
A. The 5-Day Notice is A Required Document that gives the Judge the Jurisdiction to hear the Case. Without a 5 day Notice being Properly Served, Or Lack of a 5 day notice Altogether the Case Can and Will more than Likely be Dismissed!
Q. Does Your Company Only Serve Evictions?
A. Although We Specialize in Eviction, We Serve Almost Any Documents that are Needed to be served. From VPO's, to Divorce, To Guardianship, to Garnishments.
Q. What if I DO NOT know the name of My Tenant's.
A. Sometimes, The Property is purchased with an Uncooperative Occupant, Or The Actual Tenant has moved and Left behind Unknown Family Members, or you Simply Have A Squatter Situation. In either case, you can Name The Defendant's as "Jane/John Doe, Unknown Occupants, or Occupants of (1234 Squatter Ave)
Q. If I Submit today, When Will you File The Documents?
A. We Will Try to Get All Documents Filed Within 7 days of Receipt. Our "Typical Practice" is to File in Oklahoma County on Tuesdays, Wednesdays and Thursdays. We try to File in Logan, Cleveland, and Pottawatomie County on Wednesday's, We File in Canadian County on Thursday's. Weather, Holiday's, and unforeseen Circumstances May effect these Standard Practices.
Q. If I Select Personal or Residential Service, Why is It not guaranteed?
A. Although, We Will try our Best to get you the selected Service, this is not always a possibility. The Occupant may have moved, work abnormal hours, may be on vacation, or Some other reason. In these cases, We will get posted service with certified mailing.
Q. What's the Benefit of getting Process Server to Serve the papers as opposed to getting the Sheriff?
A. The Peak hours of catching someone at home throughout the week is from 6p-9p. The Sheriff only operates during business hours of 8a-5p, Monday Through Friday. Lets not Forget to mention that the Sheriff Deputy is an Armed, Uniformed Deputy, These Facts Alone Have their own Factors as to why an Occupant wont answer. The Business hours and Uniform usually result in the Sheriff getting Posted Service. Which Typically Means NO Judgement for Money if the Defendant Does Not Appear in Court. Also, In This case the Sheriff's Dept DOES NOT do the mailing for you. This would be something you must do.
Q. What if You Are Unable to Obtain Service?
A. In Matters of an Eviction, we are Typically always able to obtain at least a Posted Service. In Matters of Service of Other Court Documents, Even though we may have good information as to their address, it is Possible to Not be able to Obtain Service. We Will make a minimum of 4-5 Attempts or Service before finally Turning in an Affidavit Stating that we were Unable to the Designated Party Served.
Q. If My Designated Party is Unable to Be Served Will I receive a refund?
A. Unfortunately, the Answer is No. We will diligently attempt to get the Party Served before finally Submitting an Affidavit of Non-Service. We Will Attempt 4-5 times Before Submitting the Non-Serve Affidavit. Your Money will be used to Compensate the Process Server for their Hard Efforts.
Q. If you are unable to get my Designated Party Served, Do I need to Pay again and Re-file?
A. No. If we were not able to get your Designated Party Served, then (On the Court date), you can Request an Alias in this Matter. The Documents at this point will need to be prepped again with a new court date, but they will not need to Paid for again
Q. What if I have More than one Defendant in my Household, Do I need to Pay for 2 Evictions?
A. No. You Only Need to Pay for one Eviction Per Household. You may need Additional Summons for Every Named Party but You Only Pay for Multiple Evictions when there is more than one Address Involved
